Use this checklist to help determine if your new or existing worker should be classified (and contracted and paid) as an employee or independent contractor.

It can be a murky area which means it isn’t always a simple determination to make. What you may have agreed with the individual, or the fact that you are paying them via invoice, are not determining factors on their own; there are a number of aspects to consider which are not of equal weighting to the decision.
